The names MyLocalPro, LLC, MyLocalPro.com, MyLocalPro, MyLocalPro Nation, and The Nation are used interchangeably for the purpose of this Agreement, with all representing the site owner.

By using this website, you accept these terms and you will comply with all applicable laws, rules and regulations.  If you do not agree with these terms, you may not use this site.  These Terms of Use are subject to change at our sole discretion at any time, and we may discontinue providing the Service, or any part thereof, with or without notice. Your subsequent use of this site at any time constitutes your acceptance of those Terms of Use in effect at that time.  For the purpose of this agreement, the term “user” shall represent visitors and/or members.

Your use of this web site is entirely at your own risk.  Our Website contains advice, recommendations, opinions, information, material from third-party Websites, material from third-party vendors and content providers that may prove to be inaccurate.  MyLocalPro.com does not make any representation as to the accuracy, timeliness, reliability or completeness of such information, statement, opinion, advice offered.  Your use of this information is at your own risk.  

Materials in this website are legal protected under copyright and trade mark laws, and all rights are reserved. Certain names, logos, designs, words, or phrases at this website may constitute trade names, trademarks or service marks of MyLocalPro.com or of other entities. The display of trademarks on this website does not imply that a license of any kind has been granted. Any unauthorized downloading, re-transmission, or other copying of modification of trademarks and/or the contents herein may be a violation of federal common law trademark and/or copyright laws and could subject the copier to legal action. Any violator will be subject to the maximum fine and penalty imposed by law.

Notwithstanding the above, Users are permitted on a limited basis to print individual pages of information that specifically contain “print” functionality. You agree to use information obtained from this site’s database only for your own private use and shall be used for personal purposes only. You are not permitted to use the site information to create any database, directory or hard copy publication of or from the databases, whether for internal or external distribution or use.

MyLocalPro.com makes no representations about any linked third party sites that you may access through this site.  These Service Provider sites are independent from MyLocalPro.com and MyLocalPro has no control over the representations or content provided in these sites.  This website does not, in any way, accept any responsibility for third party presentation.  You should take all precautions to protect yourself from the dangers of viruses, worms and other programs of potentially destructive matter.   In no event will MyLocalpro.com be liable to you or any other third party for any direct, indirect, special or other consequential damages for any use of this Site or our product(s), including, without limitation, any lost profits, business interruption, loss of programs or other data on your information handling system or otherwise, even if we are expressly advised of the possibility of such damages.

Each User is solely responsible for your interactions with other members on and from MyLocalPro.com.  MyLocalPro.com reserves the right to intervene, but is not obligated to do so. In no way, shall MyLocalPro.com be responsible for any disputes or subsequent actions resulting from disputes between members. 

MyLocalPro.com will do its best to ensure no to minimal site interruption. However, it does not warrant that service will be uninterrupted, secure or free from viruses.  In the case that site interruption occurs for an extended period of time (greater than six hours), MyLocalPro shall, at its own discretion, reimburse down time with equal extensions of the listing and/or membership term.

MyLocalPro.com disclaims all liability for the acts or omissions of other members or users (including unauthorized users, spammers, or "hackers") of the site. In no event will MyLocalPro.com be or become liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from your use of the Web site or the Service.  In no case, will MyLocalPro.com’s liability to any user exceed the amount paid by you.   

Use of the Website and/or any related services shall also be governed by our Privacy Policy.  MyLocalPro.com reserve the right to revise, amend, or modify this policy, our Terms of Use agreement, and our other policies and agreements at any time and in any manner, by updating this posting.

Members and Business Listings can be terminated by the owner (as registered with us) at any time by contacting us at customerservice@mylocalpro.com, with a request to terminate and your username and password.

Business Listings/Membership
If you wish to list your Local Business or establish Membership, then you must read this Agreement and indicate your acceptance during the registration process.  Violation of any of these terms may result in the immediate termination of your membership and civil action, if appropriate.

“Member” is hereby used to represent Nation Members and Local Business Listings.

All subscription registrations are final at the time of transaction. Any questions regarding registrations may be directed to info@mylocalpro.com.Eligibility is subject to local and regional prohibitions. You must be at least 21 years of age to become a member.  By using the Website, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all of the terms of this Agreement. It is further acknowledged that MyLocalPro.com cannot guarantee that each member is at least the required minimum age, nor do we accept responsibility or liability for any content, communication or other use or access of the site by persons under the age of 21 in violation of these terms.

Membership privileges only extend to the person or persons listed on the account. You are solely responsible for the use of your username and password.  You agree to handle Account Names and Passwords, which you may receive, as strictly private and confidential information.  MyLocalPro shall not be liable for any release or misuse of this sensitive information by you. 

When you post information or content at MyLocalPro.com, you inherently acknowledge and represent that you own and are solely responsible  for the content that you have posted and have full rights to post it for public viewing and use, including but not limited to pictures and logos. By uploading these items, you warrant that proper consent has been obtained. 

As a member, you hereby pledge and acknowledge that MyLocalPro.com provides you with profile space, but, in no way, is the owner of any content used by Members or Business Owners.  MyLocalPro.com is not and never responsible for any content contained in the profiles of its Members. However, MyLocalPro.com retains the sole rights to delete, remove, or otherwise terminate any material which it, in its sole discretion, deems be unacceptable, immoral, or illegal.

Example of unacceptable material include, but is not limited to, content that is deemed to be (i) offensive, (ii) promotes racism, bigotry, hatred or physical harm, (iii) sexual (including links to adult websites), (iv) civically or criminally unacceptable, (v) harassing, (vi) harmful to another person’s security, (vii) purposefully misleading about others, and (viii) a violation of one’s privacy and person.  Furthermore, any information, links, or content that leads directly or indirectly to the acts of spamming, site and user contamination, or any business interruption are not only unacceptable and punishable under the full letter of the law.     

While MyLocalPro.com will make its best efforts to ensure that unacceptable material is kept off of the site, MyLocalPro.com is not responsible for the content appearing in profiles. Nor is MyLocalPro.com responsible for the accuracy and reliability of said content. Information contained in Member profiles in no way reflects the opinions or practices of MyLocalPro.com.

Referral and Affiliate Programs
MyLocalPro.com offers referral compensation in several forms to its Business Listing Clients and Nation Members (collectively, “Members”). Each form of compensation is specifically linked to a specific type of Membership. You must be classified in a specific membership type to be eligible for a specific compensation plan.

A “referral” for the sake of the Programs occurs when a business or person that you have referred to our site and/or service registers and pays in full.  Furthermore, the referral must provide your username or another name that is clearly identifiable and related to your Member information.  MyLocalPro.com is not responsible for referred individuals or businesses that do not supply your referral code and will not extend a referral credit after the sign up is complete.

To be eligible for compensation, you must be a member in good standing and be party to a listing or membership that has not expired.  You are not eligible for compensation and will lose any prior compensation status, if you allow your membership to lapse.   Listing and membership renewals must be in a form and delivered within a timeframe only provided for within the site.

In the case that your Membership ceases to be in good standing, any and all outstanding compensation due to you can be forfeited.

In the case that your listing or Membership expires and is not renewed, you will be paid for any accrued but unpaid balance up to the expiration date of your listing or membership.

As a participant in all of our Referral and affiliate programs, you inherently agree to operate as an Independent Representative (“IR”).  As an IR, you will be treated as independent contractors for all federal or state tax purposes. As such, Independent Representatives will not be treated as employees, franchisees, joint ventures, partners, employees, or agents with respect to the Internal Revenue Code, Social Security Act, Federal Unemployment Act, state unemployment acts, or any other federal, state, or local statue, ordinance, rule, or regulation. All Independent Representatives shall comply with all federal and state statutes and regulations and local ordinances and regulations concerning the operation of their businesses.

All Independent Representatives are responsible for their own managerial decisions and expenditures, including all estimated income and self-employment taxes. At the end of each calendar year, MyLocalPro.com will issue an IRS Form 1099-MISC for non-employee compensation for Independent Representatives as required by law. The inability of Members to provide all information required for issuance of IRS Form 1099 will result in the suspension of payments until information is obtained. If such information is not obtained within six months from the initial request, withheld balances and any subsequent balances may be forfeited.

As an Independent Representative, you may communicate your affiliation with MyLocalPro.com, but may never represent yourself, either directly or indirectly, as an employee. All promotional material shall state that you are an Independent Rep of MyLocalPro.com.

Violation of the Independent Representative requirements or any other term of this Agreement shall result in the termination of your membership and forfeiture of any compensation accrued and due to you at the time of infraction or any time thereafter.

Independent Representatives may terminate their Independent Representative activity by simply ceasing referral efforts.  or status (separate from Membership status) at any time upon written notice.  MyLocalPro.com may suspend or terminate an Independent Representative for cause upon written notice.

Payments for compensation will be issued bi-monthly.  There is a minimum accrued balance requirement of $25.00; otherwise, your balance will roll forward until the minimum pay-out is achieved for the next scheduled payment date. All payments will be issued in the form of a check, made payable only to the name provided in the sign p and issued only to the sign up address. In the case of a business, payment will be issued in the name of the business. 

Members shall not enter into the act of Spamming when promoting MyLocalPro.com.  We have a ZERO TOLERANCE Spam policy and any violation will lead to an immediate termination. If you are not familiar with Anti-Spam Laws, then you should investigate so that you have a clear understanding. Simply, to avoid spamming violations, only extend email invitations to or make email contact with friends, family, acquaintances, existing business  associates, and individuals or businesses that have requested or directed you t forward an invitation or additional information by email.  MyLocalPro.com reserves the right to change, modify, alter, and even terminate any Referral Plan or Affiliate Program without the consent of the Members. Notice of any significant changes will be provided by MyLocalPro.com, but said notice does not need to predate such changes.  MyLocalPro.com is not required to rebate portion of fees specifically attributed to such programs. However, it is our policy to rebate any such fees collected within 90 days of said notice, so long as such changes are made in the normal course of site operation.  It is hereby stated that it is standard practice for MyLocalPro.com to offer Listing and Membership specials or discounts that may impact your compensation. Such offers do not constitute a significant change.  

MyLocalPro.com offers an Ambassador Referral Program to all businesses that place a listing in the local business directory. By placing and maintaining your listing, you are automatically enrolled in this program.  As an Ambassador, you will receive a 20% referral fee for any local business listing, or Nation Membership that you refer to us (as further detailed above). 

MyLocalPro.com offers a FREE Membership program to all standard membership of The Nation.  Refer a combination of three local business listing, and/or Nation Memberships and we will reimburse you 100% for your Membership costs, 

Gold Members are eligible for the Affiliate Referral Program.
